OPINION

ODOM, Judge.

This appeal is from a conviction for the offense of assault with intent to murder without malice. Punishment was assessed by a jury at three years.

Two grounds of error are urged, the first being that the trial court erred in submitting assault with intent to murder without malice to the jury. He argues the evidence is insufficient to show a specific intent to kill, since the weapon used was a pocket knife, which is not a deadly...
