NYE, Chief Justice.

This is a suit based on fraud. The plaintiff alleged that the defendant and his employees by the use of a fraudulent scheme deprived him of $124,191.23. Summary judgment disposed of plaintiff's suit against the employees. No appeal was had from the summary judgment. The defendant alleged, by special exception, that plaintiff's suit was barred by the two and four years statute of limitations, by laches and because plaintiff's petition...
