MEMORANDUM OPINION AND ORDER

BOWNES, District Judge.

This case arises out of an accident which occurred at a utility pole construction site in Deerfield, New Hampshire, on or about September 17, 1969. Plaintiff, an employee of the construction company, was hurt while working on a "digger" — a large mechanical holemaking device permanently mounted on a truck. He is suing the company that designed, manufactured, and distributed the digger in negligence...
