This declaratory judgment action arises out of a suit now pending in the Superior Court of Baltimore City. Kursch v. Wingate, Docket 1968, Folio 774, File No. 112110. In that case, damages are claimed for injuries sustained by Mr. Kursch when a truck operated by him was struck by a Hertz rental car alleged to have been negligently operated by Wingate.
