OPINION

BUSSEY, Judge:

Appellant, Robert Hamm, hereinafter referred to as defendant, and defendant Edmondson were charged, tried and convicted in the District Court, Muskogee County, Case No. CRF-72-239, for the offense of Murder, defendants' punishment was fixed at life imprisonment and from said judgment and sentence, a timely appeal has been perfected to this Court.
