On September 6, 1966, Bercia Lee Barbarick appeared in the Cole County Circuit Court and entered a plea of guilty to a charge of murder in the first degree. He was sentenced to life imprisonment. On January 25, 1971, Barbarick filed a motion under Rule 27.26, V.A.M.R. to set aside his conviction and sentence. A hearing was held on the motion and relief denied.
