This cause came to be heard on a petition for a writ of habeas corpus which was filed pursuant to 28 U.S.C. § 2254. The petitioner is presently incarcerated in the Lima State Hospital by reason of an order of the Court of Common Pleas of Montgomery County, Ohio.
