This is an appeal from the Court of Common Pleas of Monroe County of a conviction of a charge of driving while intoxicated.

The defendant, Donald Duane Hall, was tried by a jury of violating R. C. 4511.19, and it is from this conviction that defendant appeals.

Defendant's only assignment of error is:

"The Court erred in admitting and not striking from the jury's consideration to the testimony concerning the results of the breathalyzer...
