WHITE, Judge.

Petitioner (LeFlore) appeals from a judgment denying him post conviction relief. He was sentenced February 18, 1971, to imprisonment for an indeterminate period of not less than ten years nor more than twenty-five years pursuant to a robbery conviction. At the time he filed his petition for post conviction relief on July 14, 1971, and at the time it was heard on September 8, 1971, his direct appeal was pending in the Indiana Supreme Court.
