Plaintiff, First National Bank of Jefferson Parish, has appealed a judgment dismissing its suit on a promissory note. The bank filed suit for the unpaid balance of $3,368.16, together with interest and attorney's fees. Within three months of the filing of the petition, defendant, Gunter Kindermann, paid the bank $3,368.16. Thus the primary issue litigated in the trial court was whether, under the terms of the note, defendant was liable for attorney...
