LUMBARD, Circuit Judge:

Yao Quinn Lee appeals from an order of the Southern District, entered on October 4, 1972, denying his petition for naturalization. We vacate the judgment below and remand to the district court with a direction to dismiss.

Petitioner was born in Hong Kong in 1942, and has resided in the United States continuously since 1949. He was lawfully admitted for permanent residence on May 8, 1967. On April 6, 1971, he filed a petition for naturalization...
