This is the second appearance of this case in this court. On the former appeal, this court affirmed the conviction of the defendant, Duane Pope, on three counts of murder in the first degree, on which the death penalty was imposed. See State v. Pope, 186 Neb. 489, 184 N.W.2d 395. The current appeal follows the resentencing of the defendant Pope following the vacation of the state death...
