The problem here is whether a district rule prescribing minimum sentences is valid.

A jury found Richard Dwayne Jackson guilty of operating a motor vehicle while under the influence of intoxicating liquor, first offense. The trial court held a hearing regarding sentence, revoked defendant's driver's license for 120 days, and sentenced him to a fine of $300 and confinement in jail for 20 days...
