We have granted discretionary review of an order granting summary judgment in favor of defendant Monte Club, Inc. We affirm.

On either November 11 or 12, 1970, plaintiff, Roger M. Martinson, was injured when a pickup truck in which he was a passenger left the road. At the time of the accident, the truck was being driven by its owner, one Duane Bolme. Plaintiff sued defendant Monte Club, Inc., under the Civil Damage Act, Minn.St. 340.95...
