This cause is before us on appeal from the Felony Court of Record, Volusia County. The trial court, in its order,1 entered upon appellant's motion to dismiss, passed upon the validity of Sections 404.01(12) and 404.02(4), Florida Statutes, 1971, F.S.A., the Florida Drug Abuse Law, giving this Court jurisdiction of the direct appeal under Section 3 of Article V of the Florida Constitution...
