At about 3 a.m. on March 19, 1971, the automobile defendant was driving was stopped by two officers of the Michigan State Police. The officers thought the vehicle was making excessive noise; they suspected a faulty muffler. It is a violation of the Michigan Vehicle Code to operate a motor vehicle with a faulty muffler.
