This was a tort suit. The appellant, Cheryl Yarbrough, plaintiff below, sued the appellee Phipps, defendant below, for damages as a result of personal injuries she sustained when struck by an automobile driven by Wayne Garner. Garner's vehicle struck Phipps' automobile and then hit appellant. A jury verdict was returned in favor of the appellee at the trial in the Circuit Court of Smith County.
