Appellant, Danny Withers, hereinafter referred to as defendant, was charged, tried and convicted in the District Court of Harmon County, Case No. CRM-71-138, for a misdemeanor of Reckless Handling of a Firearm under 21 O.S. 1971, § 1289.11.
