The defendants, Lenston and Scott, were jointly tried and convicted of the murder during the course of an armed robbery of two Louisville police officers who had been dispatched to the scene of the crime; two other police officers were seriously wounded. The jury verdict determined the punishment of each defendant should be death. Both defendants appealed and the appeals were consolidated for consideration.
