WANGELIN, District Judge.
This action is before the Court upon the motion of the defendant Secretary of Labor, United States Department of Labor, (hereinafter "Secretary") alternatively (1) to dismiss (a) for lack of subject matter jurisdiction or (b) for failure to state a claim upon which relief can be granted, or (2) for summary judgment.
