A jury found the defendant guilty of attempt armed robbery and he was sentenced to serve two to seven years. He claims error in that he was reindicted on the same charge after the original indictment was dismissed for failure to conduct a preliminary hearing, and the court allowed an Allen instruction to be given to the jury along with the initial instructions.
