KELLEHER, Justice.

Harvey C. Simmons was the chief of the Coventry Police Department. On February 28, 1972, he was fired by the town council after a hearing on a charge of insubordination. Simmons appealed his firing to the Superior Court where a nonjury trial was held. The trial justice affirmed the firing and Simmons thereafter filed his notice of appeal.
