The present case confronts this court with a unique fact situation. On June 7, 1972 Natural Resources Defense Council (NRDC) and others (hereinafter NRDC or petitioner) filed in the U. S. Court of Appeals for the District of Columbia (D.C. Circuit) a petition to review certain actions taken by the Administrator of the Environmental Protection Agency (EPA).
