Bernard D. Smith was indicted by the Grand Jury of Cobb County for the offense of theft by conversion as defined by Code Ann. § 26-1808 (a) (Ga. L. 1968, pp. 1249, 1293; 1969, pp. 857, 868).

That section provides as follows: "A person commits theft by conversion when, having lawfully obtained funds or other property of another under an agreement or other known legal obligation...
