Omega Davis has appealed from the order of the trial court overruling his motion filed pursuant to Rule 27.26, V.A.M.R.

On January 10, 1951, appellant was found guilty by a jury of rape, and pursuant to the procedure then in effect pertaining to the habitual criminal act, the jury also found that appellant had previously been convicted of three felonies, and it assessed the punishment at life imprisonment.
