Defendant was first tried upon these charges at the 25 November 1970 Session of Superior Court held in Gaston County. At that trial he was found guilty on both counts in the indictment. He appealed and was awarded a new trial because of errors in the charge. State v. Melton, 11 N.C. App. 180,
