This is an appeal from a judgment of the trial court holding that the statutory will of Hezekiah Smith, dated August 30, 1971, is his last will and testament.

Hezekiah Smith died on September 3, 1971 in Caddo Parish, Louisiana. On September 7, 1971 Jerome T. Powell petitioned the court to probate Smith's statutory will dated July 23, 1971 naming him testamentary legatee and executor. There being no objection the court proceeded and an ex parte...
