OPINION BY MR. JUSTICE POMEROY, October 4, 1972:

The appellant, Jack Donald Fox, was convicted of first degree murder in May, 1970 by a jury in Huntingdon County. On appeal this Court affirmed. See Commonwealth v. Fox, 445 Pa. 76, 282 A.2d 341 (1971). On December 3, 1971 the appellant filed a Post Conviction Hearing Act petition, claiming eligibility for relief on various substantive grounds, and alleging facts in support thereof...
