The appellant was charged, tried, and convicted by a jury of the crime of Assault and Battery with a Dangerous Weapon in the District Court of Caddo County, Oklahoma, on September 21, 1970, and thereafter in compliance with the jury verdict, judgment and sentence was pronounced on October 2, 1970, fixing punishment at a term of six (6) months in the county jail.
