Frank William Weaver was indicted on April 21, 1971 for willfully and knowingly failing to submit to induction into the Armed Forces, in violation of 50 App.U.S.C. § 462. It is not disputed that defendant intentionally failed to submit to induction as scheduled on November 16, 1970. He seeks to defend this prosecution by proving his induction order...
