STATON, Judge.

Without being represented by an attorney, Phillip DeFrisco, age twenty-seven, pleaded guilty to possession of cannabis (marijuana) at his arraignment held on August 22, 1971. A pre-sentence investigation was made before he was sentenced to the Indiana State Reformatory for not less than one year nor more than ten years.

With representation by an attorney, he filed a motion to withdraw his guilty plea on August 30, 1971. A hearing was held August...
