The petitioner, Fred J. Bowen, was convicted of murder in the first degree and sentenced to death. The Court of Criminal Appeals affirmed the judgment of the Criminal Court, one of the judges in a separate concurring opinion recommending that the Governor commute the death sentence to one of imprisonment for ninety-nine years.
