Defendants move by order to show cause, pursuant to paragraph 4 of subdivision (a) of CPLR 5015 to (1) vacate a judgment on default entered on March 7, 1968 on the grounds that the court lacked jurisdiction to render such judgment in that the summons and complaint were allegedly never served upon the defendants, and (2) to compel the plaintiff to make restitution in the amount of $1,706.15.
