Court of Appeal of Louisiana, Third Circuit.

Rehearing Denied October 25, 1972.

Writ Refused November 21, 1972.

Attorney(s) appearing for the Case

Gist, Methvin & Trimble by H. B. Gist, Jr., Alexandria, for defendants-appellants.

Ford & Nugent by Howard N. Nugent, Jr., Alexandria, for plaintiff-appellee.

Before FRUGÉ, MILLER and DOMENGEAUX, JJ.

MILLER, Judge.

Defendants USF&G and its insured Hixson Brothers, Inc., appeal the trial court award of total and permanent workmen's compensation benefits to plaintiff Wilmer G. Gatheright. Plaintiff answered the appeal seeking penalties and attorney's fees. We affirm.

Appellants contend that Gatheright waived his rights to workmen's compensation by signing the following instrument without which Gatheright would not have been employed.
