On August 17, 1965, the appellant, Madrid Defond Roberts, entered a plea of guilty to Count I, assault with intent to commit a felony other than assault with intent to kill, and Count II, burglary in the third degree, in the Circuit Court of Day County, South Dakota. He was sentenced to the state penitentiary for a period of ten years on Count I and to fifteen years on Count II, the sentences to run concurrently...
