Defendant moved under Rule 41(e) of F.R.Crim.P. to suppress as evidence certain marihuana seized by the government during a search of his home. A hearing was held on February 4, 1972, when, in view of the government's failure to submit any memorandum in opposition to defendant's motion, this court requested the Ass't. U. S.
