Appellant was charged by affidavit in three counts: Count 1. Conspiracy to commit a felony, to-wit: second degree arson; Count 2. Entering to commit a felony; and Count 3. Placing combustibles to destroy property. Trial by jury resulted in a verdict of guilty on Counts 2 and 3. The jury failed to reach a decision on Count 1.
