OPINION BY JUDGE KRAMER, March 13, 1972:

This is an appeal from an Order of the Common Pleas Court of Philadelphia County discharging a rule to show cause why the appeal taken by Rohm & Haas Company, Inc. (appellee) should not be dismissed.

This action was commenced on June 7, 1971, by the filing of a "Code Enforcement Complaint" filed by the City of Philadelphia against the appellee charging it with ". . . odor emissions in violation of Section 3-201...
