Appellee, Herider Farms, Inc., (hereinafter called Herider) brought suit against appellants W. G. Tufts and Son (hereinafter called Tufts), and Granville Battles for damages for the loss of 24 head of cattle and diminution in value of 12 others, for loss of hay, services of a veterinarian, damages to land and attorney's fees.
