STOUT v. KEHLENBACK

Nos. Q-143, Q-144.

265 So.2d 514 (1972)

Ivan STOUT and Helen A. Stout, Appellants, v. William J. KEHLENBACK et al., Appellees.

District Court of Appeal of Florida, First District.

Rehearing Denied August 28, 1972.

Attorney(s) appearing for the Case

Paul Bernardini, of Stern and Bernardini, P.A., Daytona Beach, for appellants.

Robert W. Elton, of Sands, Smalbein, Eubank, Johnson, Rosier & Bussey, Daytona Beach, for appellees.

PER CURIAM.

This appeal questions the correctness of a summary judgment rendered in favor of appellees.

A careful examination of the record on appeal conclusively established the absence of any genuine triable issue of a material fact and that appellees were entitled to judgment as a matter of law. The judgment appealed is accordingly affirmed. F.S. Sections 767.01-767.04, F.S.A.; Reid v. Nelson (5th Cir.1946)
