BUSSEY, Presiding Judge:

Appellant was charged, tried by a jury, and convicted for the offense of Operating a Motor Vehicle While Under the Influence of Intoxicating Liquor on July 3, 1970. Judgment and sentence entered on the 27th day of September 1971 fixed punishment at ninety (90) days in the county jail, forty-five (45) days of which were suspended, and a fine in the amount of Fifty ($50.00) Dollars...
