Claude Howard Jones was tried and convicted by a jury of the offense of murder in the first degree. His motion for new trial was overruled, he was sentenced to life imprisonment and he now appeals.

Appellant and the victim of the alleged offense were inmates of the same cell house at the Kansas State Penitentiary at Lansing on May 30, 1968, when the latter...
