The appellee, Patterson Agency, Inc., instituted this suit against appellants, Mr. and Mrs. Leo Wyand, in the Circuit Court for Washington County to recover a real estate commission allegedly owed it. At the same time it filed its declaration, appellee included a motion for summary judgment which it attempted to support by an affidavit. Judge Rutledge granted the motion.
