Appellant, Joseph S. Newbrough, Jr., was dismissed from his employment with the Department of Highways by letter dated November 2, 1970, which reads in part as follows:

"This is to advise that your services with this Department will be terminated effective November 6, 1970, at the close of work. "The reason for this action is your poor health and inability to improve your condition sufficiently...
