This case arises from events first occurring in 1965. In that year the plaintiff, Piedmont Aviation, Inc. (Airline), decided to buy twelve Boeing 737 twin-turbojet aircraft (737). In the following year the defendant, the Air Line Pilots Association, International (Alpa), revised its crew complement policy to provide for a three-pilot crew on all turbojet aircraft certified after 1966.
