On March 16, 1971, two petitions were filed in the magistrate's division of the Third Judicial District in the interest of Gary D. Gibbs, a child under eighteen years of age. The petitions alleged that Gary, then seventeen years old and residing in Oregon near Weiser, Idaho, committed two separate acts of first degree burglary with the intent to commit larceny on the night of March 10, 1971, in Idaho.
