We conclude that the conviction of defendant of the counts of attempted murder in the first degree, based upon an "act imminently dangerous to others, and evincing a depraved mind, regardless of human life, although without a premeditated design to effect the death of any individual" (former Penal Law, § 1044, subd. 2), is supported by law and the record here.
