Defendant, charged with second-degree murder, was found guilty by a jury of manslaughter (MCLA § 750.321 [Stat Ann 1954 Rev § 28.553]) and from his conviction and sentence he appeals.

The death occurred in defendant's ex-wife's apartment and resulted from a single bullet which entered the center of deceased's forehead. On the day in question, defendant went over to his ex-wife's apartment...
