McCarty, appellee herein, brought suit against Del Rio Bank & Trust Company for the alleged wrongful and negligent transfer of $4,000 from her special account into a joint checking account which she had with her husband. The parties will be referred to herein as they were in the trial court. The jury's verdict exonerated the defendant of negligence, but the trial court granted plaintiff's motion for judgment non obstante veredicto...
