LEWIS, Justice:

Upon appellant's trial for assault and battery with intent to kill, the trial judge refused timely requests that the issue of self defense be submitted to the jury under appropriate instructions. Appellant was convicted of assault and battery of a high and aggravated nature, from which he has prosecuted this appeal. The sole question to be decided is whether the lower court erred in refusing to submit the plea of self-defense...
